The C-BRTA has identified Section 25(1), 39(1) and 40 of the Cross Border Road Transport Act, 1998 (Act No, 4 of 1998) for the Authority (BMA) to enforce on its behalf within the border enforcement area and at a port of entry.
The roles and responsibilities of the BMA are to:
- Ensure that the drivers have a valid cross-border permit for the vehicle in order to be allowed entry or departure from the Republic of South Africa;
- Refuse entry or exit if the driver does not possess a valid cross border permit for the vehicle;
- Impound a vehicle that is in contravention of the Cross-Border Act;
- Advise the driver to obtain a permit from the Agency or their respective Authority.
The C-BRTA
- Will provide training to the border guards on its functions
- Provide support to the border guards on its functions, powers and duties as contemplated in the C-BRT Act
- The Agency will also provide access to its electronic systems for the purpose of verification of valid permits to the BMA.
The BMA is fulfilling their mandate as stated in the Border Management Act ,2020 (Act No.2 of 2020) stating that in realization of the BMA Act 27(2)(3), the Authority must within a reasonable time, enter into protocol with other organs of state.
